PUBLIC NOTICE OF PROPOSED CHANGES TO THE RULES, REGULATIONS
AND FEE SCHEDULE OF THE WYOMING WORKERS’ COMPENSATION
DIVISION
PUBLIC NOTICE IS HEREBY GIVEN that the Wyoming Workers’ Compensation
Division is proposing changes which will affect the Division’s rules, regulations and fee
schedule. These proposals include modifications to the Wyoming Workers’
Compensation Rules, Regulations and Fee Schedules;
The Department is proposing the following changes to Chapter 2, Employer Coverage
and Compliance:
Section 3, Experience Rating – The Division is changing the experience modification
rating formula to one which incorporates both frequency and severity components. The
new formula is consistent with actuarial methods. Also, the Division is amending its
rules in order to comply with statutory changes to Wyoming Statute § 27-14-201(d),
which allows for employers to appeal third party claims charges to their experience
modification rate for a final determination. The statute requires the Division to provide
rules which will determine the procedure for such a determination.
Section 5, Audits –Added (a)(i) to clarify an employer’s audit regarding documentation
for independent contractors.
Section 7, Deductible Program – Added (e) to explain when the deductible is applied to
the employer’s industry base rate before any discounts are calculated and applied.
Section11, Joint Reporting – repealed
Section 14, Employer Reimbursements or Allowances for Employee Business
Expenses – This is a new section and reflects the same standards as used in the
Unemployment Insurance rules, Chapter 11, Records, Inspections and Reports, Section
4(a)(b). The UI/WC Auditors will have the same review authority with Workers’
Compensation as they currently do with Unemployment Insurance.
A Glossary of Terminology was added to explain the terms used in the split plan
experience rating calculation.
