PUBLIC NOTICE IS HEREBY GIVEN that the Wyoming Workers’ Compensation
Division is proposing changes that will affect the Division’s rules, regulations and fee
schedule. These proposals include modifications to the Wyoming Workers’
Compensation Rules, Regulations and Fee Schedules;
The Department proposes minor grammatical and formatting changes as well as the
following specific changes to Chapter 1 – General Provisions:
Section 3 – Definitions:
(l) Clerical Office Occupations – first sentence – deleted “where such books and
records are kept”. This is in regards to those who work from home or telework
during a pandemic. The end of this paragraph was changed to add “or the primary
business location if travel is compensated by the employer.
(i) First sentence – deleted “name”, “each worker for whom” and “is”; added
“number of clerical positions needed” and “the” and “being”.
The updated sentence is: “Employers must request the clerical coverage
classification in writing on a form prescribed by the Division showing the number
of clerical positions needed and a detailed description of job duties and
responsibilities for the clerical coverage being requested”. These changes will
make it easier for the employer to request clerical classification positions. It will
also make it easier for the Employment Tax Division to audit files.
(ff) Medical Service. Means any medical, surgical, diagnostic, chiropractic, hospital,
nursing care, ambulances, prescription medicine, durable medical equipment,
prosthetic appliances, and physical restorative services.
Durable medical equipment (DME) is being struck. Medical services do not include
durable medical equipment. DME is being fully addressed in present proposed changes
in Workers’ Compensation Chapter 10, Section 8.
Section 6 – Rules Governing Public Records Requests – this section is being repealed. It
will be consolidated into DWS Chapter 1 rules.
