WAGE REPORTING EXEMPTIONS

Please do not include wages of exempt individuals on the “Employee Wage List” or in the “Summary Report.”

Owner and Officer Coverage: What you need to know—and how DWS can help

Electing coverage

Owners are not automatically covered under Workers’ Compensation. To add coverage, a written request is required using an Affidavit of Coverage provided by the Division. Call (307) 777-6763 and the Employer Services team will help you get started.


Who can elect coverage

Workers’ Compensation coverage may be elected for:

  • Corporate officers
  • LLC members
  • Sole proprietors
  • Partners
Important note for corporations:

Coverage is tied to the position, not the person. If officers change, notify the Division within 30 days. Coverage automatically transfers to the newly elected officer in the same position.


How to report wages

If coverage is elected

  • Report owners and officers under the assigned “C” class code (for example, 211210C).
  • Use the statewide average wage; do not report actual wages or zero wages.
  • If your business does not have a “C” class code, officer or member coverage has not been elected.

If coverage is not elected

  • Do not report wages for officers, members, sole proprietors, or partners.
  • These individuals are not covered under Workers’ Compensation.

When coverage starts

New corporations or LLCs

  • Coverage begins the first day of the reporting period after your account is established, if the written election is filed within 30 days.
  • Elected coverage must remain in place for at least eight calendar quarters.

Existing corporations or LLCs

  • File the written election at least 30 days before the start of a calendar quarter.
  • Coverage begins the first day of the next quarter.
  • Coverage must remain in place for eight calendar quarters.

Canceling elected coverage

To end owner or officer coverage, submit a written cancellation request to the Division.
Coverage ends the first day of the month after the request is received.

Need proof of coverage—fast?

If you need immediate proof of compliance, email dws-wccert@wyo.gov to request a temporary certificate of good standing.

Include:

  • Your business name, mailing address, and FEIN
  • The name and mailing address of the company requesting the proof

Employees working out of state

Wyoming Workers’ Compensation generally covers employees who are based in Wyoming and temporarily working in another state.

  • Wyoming has reciprocal agreements with:
    Idaho, Montana, North Dakota, South Dakota, Ohio, Oregon, Utah, Washington, and Nevada
    Note: Nevada coverage does not apply to construction employers with class codes 23XXX.
  • If employees work in states without a formal agreement, coverage may still apply for short-term or incidental work, as long as the employee is reported to Wyoming and files a claim with the Wyoming State Fund.

Important:
Wyoming coverage does not replace another state’s legal requirements. Employers are responsible for meeting all workers’ compensation laws in the state (or country) where work is performed. This also applies to temporary work in Canada or Mexico.
