Wyoming employers may consider hiring foreign workers when they are unable to fill open positions with qualified U.S. workers.

Federal law requires that, before a foreign worker can receive a visa for permanent employment:

  • There are not enough U.S. workers who are able, willing, qualified, and available for the job at the time and location needed; and
  • Hiring a foreign worker will not negatively impact the wages or working conditions of U.S. workers in similar positions.

How the Wyoming Department of Workforce Services Can Help

The Wyoming Department of Workforce Services (DWS) assists employers with the immigrant labor certification application process. This process helps ensure that foreign workers are hired in a way that is fair to employers, Wyoming workers, and foreign labor in both agricultural and non-agricultural industries.

DWS reviews and monitors applications at the state level; however, final certification decisions are made by the federal government.
