CHEYENNE – The Department of Workforce Services (DWS) is seeking public comment on the proposed Workers’ Compensation program rules Chapter 9: Fee Schedules. The Workers’ Compensation Division reviews Chapter 9 annually to identify areas where the division can improve the processing of medical bills. Many proposed changes are based on provider feedback and help to streamline processes for providers.

The most significant proposed changes include:

  • Referencing the newest resources and publications for adjudicating medical bills.
  • Increasing dental reimbursement from the 50th percentile to the 85th percentile of the FAIR Health Data benchmark.
  • Clarifying that a supplier’s invoice is required for any supplies and/or implants charged at $5,000 or more.
  • Modifies inpatient services paid to Critical Access Hospitals (CAHs) from 150% of the Rural Cost to Charge Ratio to a flat 80% of billed charges. This modification will increase the reimbursement rate for CAHs for both inpatient and outpatient services.

The proposed changes can be viewed in the strike and underlined version. More information on the changes is available in the statement of reasons.

The public comment window is open through Dec. 19, and comments may be submitted using the online form.
